  3. PowWow copyright (C) 1995, 1996, 1997 by Tribal Voice, Inc.  All rights 
  4. reserved.  This software is based in part on the work of the 
  5. Independent JPEG Group.

  7.     By using PowWow, you agree to abide by the terms of this License to 
  8. the best of your ability.
  9.  
  10.     PowWow is distributed free-of-charge for personal use by individuals 
  11. and use by educational institutions.  All others wishing to use PowWow 
  12. must obtain a site license from Tribal Voice.  Licensing information is 
  13. available by contacting Tribal Voice.
  14.  
  15.     PowWow must be distributed complete and intact without modifications 
  16. whatsoever.  No modifications are allowed, including BBS advertisements 
  17. and modifications to the distribution .ZIP file.  PowWow may be 
  18. distributed on BBSes, Internet FTP sites, commercial online services, 
  19. and on CD-ROMÆs containing public domain, freeware, and shareware 
  20. programs.  In the case of CD-ROM distribution, notice must be given 
  21. that the disc contains shareware with an explanation of the shareware 
  22. concept, such as in the distribution notices required on the SimTel and 
  23. Garbo CD-ROMÆs.

  25.     For permission to distribute PowWow with a magazine, book, or bundled 
  26. with another product contact Tribal Voice.
  27.  
  28.     You agree you will not attempt to reverse compile, modify, translate, 
  29. or disassemble PowWow in whole or in part and that you will make 
  30. reasonable efforts to prevent anyone from doing same.
  31.  
  32.     You agree you will allow Tribal Voice to contact you for purposes of 
  33. announcing new releases, bug-fixes, and other technical and business 
  34. information.
  35.  
  36.     Tribal Voice warrants that PowWow will perform substantially for a 
  37. period of sixty (60) days from the date of license.  Any implied 
  38. warranties relating to PowWow are limited to sixty (60) days.  
  39.  
  40.     If PowWow does not conform to the limited warranty above, Tribal 
  41. VoiceÆs entire liability and your sole and exclusive remedy shall be, 
  42. at Tribal VoiceÆs option, either to (a) correct the error or (a) help 
  43. you work around or avoid the error.  The limited warranty is void if 
  44. failure of PowWow is due to accident, abuse, or misapplication, 
  45. including use of PowWow with beta-test or non-compliant operating 
  46. systems and software.  Any replacement will be warranted for the 
  47. remainder of the original limited warranty period.
  48.  
  49.     Tribal Voice does not warrant that PowWow is error-free.  Except for 
  50. the express limited warranty above, Tribal Voice disclaims all other 
  51. warranties with respect to the software, either express or implied, 
  52. including but not limited to implied warranties of merchantability, 
  53. fitness for a particular purpose, and noninfringement of third-party 
  54. rights.
  55.  
  56.     In the event of invalidity of any provision of this license, the 
  57. parties agree that such invalidity shall not affect the validity of the 
  58. remaining portions of this license.
  59.  
  60.     In no event shall Tribal Voice be liable for consequential, incidental 
  61. or indirect damages of any kind arising out of the delivery, 
  62. performance or use of the software, even if Tribal Voice has been 
  63. advised of the possibility of such damages.  In no event will Tribal 
  64. Voice's liability for any claim, whether in contract, tort or any other 
  65. theory of liability, exceed the license fee paid for PowWow, if any.
  66.  
  67.     This license will be governed by the laws of the State of Colorado as 
  68. they are applied to agreements between Colorado residents entered into 
  69. and to be performed entirely within Colorado.  The United Nations 
  70. Convention on Contracts for the International Sale of Goods is 
  71. specifically disclaimed.
  72.  
  73.     If PowWow is acquired (i) for use by the DOD, use, duplication or 
  74. disclosure by the Government is subject to the terms of this license 
  75. unless superseded by 252.227-7013(c)(1)(ii) or (ii) for use by civilian 
  76. agencies, use, reproduction, or disclosure is subject to the terms of 
  77. this license unless superseded by 52.227-19.

  79.     The PowWow documentation makes reference to a number of copyrighted 
  80. and trademarked products.  Rather than point out each one individually, 
  81. weÆll just mention here that they are copyrighted and trademarked by 
  82. their respective holders.
